The Decline Of The Democratic President

Not many people are going to read this article and I’m not writing it for many people. I’m writing it because it has to be written.  As we learned in school, there are three branches to our government, Executive, Legislative and Judicial. The President of the United States administers the Executive Branch of our government and enforces the laws that the Legislative Branch makes. The Legislative part of our government is called Congress. Congress makes our laws. Congress is divided into 2 parts. One part is called the Senate. There are 100 Senators–2 from each of our states. Another part is called the House of Representatives. Representatives meet together to discuss ideas and decide if these ideas (bills) should become laws. There are 435 Representatives. The number of representatives each state gets is determined by its population. Some states have just 2 representatives. Others have as many as 40. Both senators and representatives are elected by the eligible voters in their states. The Judicial part of our federal government includes the Supreme Court and 9 Justices. They are special judges who interpret laws according to the Constitution. These justices only hear cases that pertain to issues related to the Constitution. They are the highest court in our country. The federal judicial system also has lower courts located in each state to hear cases involving federal issues.

For the purposes of my article, I want to first focus on the Executive branch and the Legislative branch. The President of the United States administers the Executive Branch of our government and enforces the laws that the Legislative Branch makes. Currently the legislative branch is controlled by conservatives or in political parlance, the Republicans. The legislative branch controls the House of Representative and Senate. I’m not going to go over every bill this 115th congress has passed or tried to pass. For brevity we will just mention a few.

  1. Tried to repeal the Affordable Care Act ( ObamaCare)
  2. Turned back the Dodd Frank Act ( A federal law that places regulation of the financial industry in the hands of the government.)
  3. Curved Environmental Protections. (Approved the Keystone pipeline that recently spilled 20 thousands gallon of oil.)
  4. Cut Workers Rights ( I would cuss here , but check out this link. )
  5. Assailed woman’s rights with the aim of repealing Roe V. Wade.  ( Pay attention to “settled law, but courts can always over-rule precedent.”)

Just these five cases are on the Supreme Court docket,  or are on the lower courts docket, or will be brought to the supreme court for adjudication in the future. As of September 22, 2018, the United States Senate has confirmed 68 Article III judges nominated by President Trump, including 1 Associate Justice of the Supreme Court of the United States, 26 judges for the United States Courts of Appeals,  and 41 judges for the United States District Courts. The president is only in his second year. As we read earlier, the President of the United States administers the Executive Branch of our government and enforces the laws that the Legislative Branch makes. The Judicial part of our federal government which includes the Supreme Court and 9 Justices are special judges who interpret laws according to the Constitution. Remember there are also lesser federal judges that also interpret federal law.

Whats the problem? We just elect a Democratic house and Senate. We even elect a Democratic President. We change the laws and like magic the problem disappears. I’m afraid not. If some entity bring the matter to the courts, it first must go thru the lower courts. Then if it get to the Supreme Court and if they ” decide to hear it,” what do you think will happen if the law is progressive and its facing a conservative court. The first Civil Rights Law was passed in 1875, it wasn’t until 1964 that we got Civil Rights as we know it today. Its no wonder that the Republican are retiring at a rate unheard of in modern history. They don’t have to control the Congress if they control the Judiciary. The President job is to “uphold the law.” They don’t need senators, congressman, lobbyist, voters or a Republican President and its cheaper too. Who is the “they” you talking about? I’m talking about the corporations and the very wealthy. The entities that fund the members of congress. Who do you think gave the lobbyist the money to change the law so that they can pour unlimited dollars into campaigns. They spend hundreds of millions of dollars on lobbyist. Somebody finally figured out its cheaper to change the law than to keep paying lobbyist millions of dollars to change someone mind, paying senators and congressman who you can’t trust, buying votes that depending on circumstances can turn on a dime, or a President you can’t control.

If its all a scam, then whats the reason to vote? Nothing new here. This is a trick question. Voting is not the scam. I might as well ask, “If the chicken crossed the road, then why is it raining in Tripoli?” They have nothing to do with each other. The question is just to stop you from voting. You start at the local level and work your way up. The legislature make laws. Sure your choice is going to have a very hard time getting to national politics, but they will not get there at all if you don’t vote. The legislature make laws. Not voting is the scam.
