I don’t want to write this story. It’s not like it has not happened before. There have been a lot of people, including children who were just sitting in their homes, minding their own business and have been shot and killed. Usually its from a stray bullet fired by gang members or police firing at fleeing suspects. But I have never heard of someone coming into the wrong home and killing someone, believing they had broken into their home. Furthermore, the person who is charged, is supposed to be trained in observation and detail. To think that this person was roaming our neighborhoods armed with a 9 mm glock. Additionally,  there are witnesses who said that before the gunshots, they heard the officer knocking at the door and repeatedly saying, ‘Let me in. As of now, there have been no reports romantically linking the two together. No matter how you look at it, she is going to get some time. Most likely involuntary manslaughter. Involuntary manslaughter is a killing that stems from a lack of intention to cause death but involving an intentional, or negligent, act leading to death. Then you got to deal with mitigating circumstances. Now mitigating circumstances do not constitute a justification or excuse of an offense, but may be considered by the courts as reducing the degree of culpability. Take for instance, she said she just finished a 14 hr shift and she is a policewoman. On the other hand, there are aggravating circumstances also.

Like this picture of her with her family. To the uninitiated, her brother-in law looks like he is giving the white power sign. However the “Root” reports the Anti-Defamation League took a look at the photos. ADL spokesman Jake Hyman said experts with his organization “don’t think there is any white supremacist intention here.” Garza, the brother-in law said the photo was taken when the family was out celebrating his father-in-law’s 69th birthday, and his hands are supposed to be signaling the number 69. So there is a lot of stuff out there in the jury pool. I know how we as a community feel and believe me my first inclination was join the crowd in shouting, “We want her head on a stick with nails in it!!!” But the truth of the matter and as it now stands, all we have is a idiot with a gun who killed another blackman, I believe by mistake. I don’t mind cutting off racist low hanging fruit if they deserve it, but I’m not cutting off anything solely based on the color of their skin. They got to deserve it. I’m not going to live like that. Federal guidelines for involuntary manslaughter means anything from a fine, up to 8 years imprisonment.  Under Texas state law, this offense can result in a prison sentence from two to 20 years and/or fines up to $10,000. Criminally negligent homicide is generally a Texas jail felony. A conviction for this offense is punishable by a jail sentence from 180 days to two years and/or a fine up to $10,000. This is what I think her attorney will be going for. By the way, I hope who ever thought of slandering Botham’s name and reputation by issuing a warrant to search his apartment for drugs, is a “POS.” That’s where a lot of this hate is coming from. The last thing is although no amount of money will bring Botham back or lessen the pain and heartbreak the family is going through, I hope they sue the ever loving hell out of them.
