The 5th and 14th amendments to the U.S. Constitution guarantee “due process of law” to all persons, including foreign students and other aliens in the US. Due process of law requires that orderly legal procedures be followed to establish guilt before a person can be put in jail or otherwise punished. In the United States, a person is considered innocent until proven guilty. The 14th amendment to the US Constitution guarantees to every person, aliens included, “equal protection under the law.” Equal protection under the law means that the law applies to everyone equally, regardless of age, sex, race or wealth, and that no law may discriminate between persons or classes of persons.
Jussie Smollett was not afforded due process of law. I like many of us thought he was guilty. I still think he is guilty. But he deserves due process. When you have the Mayor, Chief Of Police and States Attorney go on national and international television and say you are guilty, you just poisoned the entire jury pool and violated my 5th Amendment guaranteeing me due process. If you some just some little insignificant piss ant like me, they can get away with it, I don’t have enough money to get lunch in the cafeteria, less more take this to another court.. give me the plea. However if you big dollar, don’t even have to holler, get my big time lawyer Jussie Smollett, then they can’t get away with it. Yep, my big time lawyer will take this case all the way to the Supreme Court. You will spend millions on a case you usually plea out and you will probably lose anyway. The city got caught up in the hype of bringing a high value black man down and it didn’t work out for them.
